(hereinafter referred to as “NOW Italia” or the “Company”), pursuant to Art. 13, Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to processing of personal data (hereinafter referred to as “EU Regulation”), wishes to inform you that, the Company needs to proceed with the processing of your personal data, collected in an automatic way or provided by you by browsing or using the website https://www.energiaitalia2022.it (hereinafter referred to as the “Website”).

1. DATA CONTROLLER

The Data Controller is NOW Italia, in the name of its legal representative, with address for service in Ancona, Via Santo Stefano 27, Italy (hereinafter referred to as the “Data Controller”).

2. TYPES OF DATA PROCESSED

In order for you to use the Website and its services, including the opportunity to receive our daily newsletters containing all the articles published on the Website and invitations to our events (hereinafter referred to as the “Services”), the Data Controller needs to know and process some of your personal data.

  • Browsing data
    The computer systems and software procedures used to operate the Website collect, as part of their routine operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

This category of data includes the IP addresses or domain names of computers used by users who connect to the website, the URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to send the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and computer environment.
These data, which are necessary for the use of the Website, are processed for the sole purpose of obtaining statistical information on the use of the Services (most visited pages, number of visitors per time slot or per day, geographical areas of origin, etc.) and to check the correct functioning of the Services offered.

  • Data provided voluntarily by users

The optional, explicit and voluntary sending of emails implies the acquisition of the sender’s e-mail address, as well as any other personal data contained in the requests you have submitted.

3. PURPOSES, LEGAL BASIS AND NATURE OF THE PROVISION

The personal data processed by NOW Italia are exclusively those you provided by using the Website. These data will be processed exclusively for the following purposes:

a. to enable the use of the Website and its Services, including, upon your request, the sending to your email address of our daily newsletter containing all the articles published on the Website and invitations to our events. The legal basis for the processing is the performance of a contract to which you are a party. The provision of your personal data for this purpose is mandatory, because your refusal to do so would prevent us from delivering the Services.

Your personal data may be processed both by computer and on paper.

4. PERSONAL DATA STORAGE PERIOD

The Data Controller will retain your personal data for a period not longer than that necessary to achieve the purposes for which they are collected and processed.

The data provided for subscription to the newsletter will only be stored for the period during which the service is active. Profiling data will be stored for 12 months after collection.

This is without prejudice to the case in which we will need to retain such data in order to comply with regulatory obligations, or to ascertain, exercise or actively defend our rights in court.

5. CATEGORIES OF RECIPIENTS OF THE PERSONAL DATA

The data processed shall not be disclosed to third parties. However, for the fulfilment of the above-mentioned purposes, your personal data may be disclosed to:

  • those who can access data in accordance with legal obligations under Union or a Member State Law to which the Data Controller is subject;
  • those who perform, in complete autonomy, activities related to the activities and services mentioned in paragraph 3, as separate Data Controllers, as well as Data Controllers appointed to this end by NOW Italia, or also companies providing services for drafting and sending our newsletters, companies organising events, insurance companies, law firms, companies providing computer assistance and consultancy as well as design and implementation of software, service centres, companies or consultants responsible for providing services to the Data Controller, within the limits of the purposes for which they were collected;
    In addition, your personal data may be also disclosed to our employees, provided that they have been previously designated as persons acting under the authority of the Data Controller, according to Art. 29 of the GDPR.

Any disclosure of your personal data will be done in full compliance with the legal provisions of the GDPR and the technical and organisational measures adopted by the Company to ensure an appropriate level of security.

6. TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES

The entire processing of personal data takes place within the borders of the European Union. Therefore, the Data Controller does not transfer your personal data to third countries.

7. AUTOMATED DECISION-MAKING PROCESSES

If you explicitly consent to the processing of your personal data to receive our daily newsletters containing only the articles published on the Website and invitations to our events in line with the selected fields of interest, the Data Controller will use automated processes aimed at profiling your preferences. The aim is to offer you the opportunity to receive newsletters and invitations matching with your interests and preferences. Therefore, as a consequence of profiling activities, you may benefit from receiving contents tailored exclusively to your interests.
In any case, pursuant to Article 22, subparagraph 3, of the EU Regulation, the Data Controller takes all the most appropriate measures to protect your rights and liberties, also in case of profiling, in addition to any other legitimate right, as better specified in the subsequent paragraph (“Rights of the Data subject”) of this Privacy Policy.

8. RIGHTS OF THE DATA SUBJECT

With regard to the processing of your personal data, in accordance with the GDPR, as data subject, you have the right to:

  • Withdraw your consent to the processing at any time;
  • Request access to your personal data from the Data Controller;
  • Obtain from the Data Controller the rectification and completion of your personal data when incomplete;
  • Obtain from the Data Controller the erasure of your personal data, if applicable;
  • Obtain from the Data Controller the restriction of the processing of your personal data, if applicable;
  • Exercise your right to personal data portability;
  • Object, at any time, on grounds relating to your particular situation, to the processing of your personal data;
  • Not to be subject to decisions based solely on automated processing, including profiling;
  • Lodge a complaint with a supervisory authority (Article 77) or before the competent courts (Article 79), if you consider that your rights, according to the GDPR, have been infringed as a result of the processing.
